2.2 "Collection Item(s)": Eligible furniture items we agree to collect from you.
2.3 "Clearance Product(s)": Products sold at a reduced price, including showroom or warehouse clearance items.
2.4 "Guarantees": Our guarantees are outlined in Clause 11.
2.5 "Product(s)": Sofas, armchairs, beds, footstools, cushions, mattresses, and other products we sell.
2.6 "Standard Range": Products listed on our website in standard sizes and fabrics.
2.7 "Website": www.luxuryhomes.shop and associated web pages.
3. Customer Location
3.1 Our website is primarily intended for UK residents. Orders from outside the UK may be accepted at our discretion.
3.2 Delivery and returns policies vary by location. Please refer to Clauses 7, 9, and 11 for details.
4. Product Specifications
4.1 You are responsible for choosing suitable fabric colors and ensuring product dimensions fit your intended use.
4.2 Product dimensions may slightly vary but will be within a 1.5% tolerance.
4.3 We strive for accurate color representation on our website, but actual colors may vary.
4.4 Leather products may exhibit natural marks and scars.
4.5 We continuously develop our products and may alter specifications without prior notice.
4.6 We may substitute products if necessary, subject to your acceptance.
5. Prices
5.1 All prices include VAT at the standard rate and are subject to promotional offers or discounts.
5.2 Quoted prices are valid for 28 days, unless otherwise stated.
6. Payments
6.1 A minimum 25% deposit is required for all orders. The balance is due 7 days prior to delivery/collection.
6.2 Failure to pay the outstanding balance may result in order cancellation or interest charges.
6.3 Orders where the balance remains unpaid may have delivery canceled without notice.
6.4 Full payment is required for online orders unless a credit payment plan is arranged.
6.5 Credit payment plans are subject to status and available only to UK residents aged 18 and over.
7. Delivery
7.1 Delivery times are approximate, and we are not liable for any consequential loss due to late deliveries.
7.2 A nominal delivery charge applies within our delivery area, subject to change.
7.3 Delivery attempts may be aborted if deemed dangerous or likely to cause property damage.
7.4 Products ordered online aim to be delivered within 8-12 weeks for UK Mainland addresses.
7.5 If you cannot accept delivery within the specified time, we will store your order for 14 days.
7.6 Damage to your property during delivery must be reported within 48 hours.
8. Risk and Title
8.1 Risk for the Products passes to you upon delivery.
8.2 Ownership of the Products passes upon full payment.
9. Cancellations and Returns
9.1 Amendments or cancellations of bespoke orders may incur a fee.
9.2 Cancellation rights apply to online purchases only.
9.3 Products must be returned in a saleable condition.
9.4 Refunds will be made using the same payment method as the original purchase.
10. Customer Own Materials
10.1 Customer-supplied materials must be safe and suitable for use.
10.2 We own the materials once received but will return any excess or unused materials upon request.
11. Guarantees
11.1 Our guarantees do not cover misuse, accidental damage, or wear and tear.
11.2 Guarantees begin from the delivery date and apply to products sold and retained in the UK for non-commercial use.
12. Fabrics
12.1 Fabrics are guaranteed against manufacturing defects for 1 year.
12.2 Sunlight can fade fabrics; we recommend protecting them from direct exposure.
12.3 We cannot guarantee exact color matches for subsequent orders
12.4. Fabric protection treatment, where applied, is covered under a 5-year guarantee. Further details are available upon request.
12.5. Variations in fabric batches, particularly in color and texture, may occur, and we cannot guarantee exact matches for subsequent orders.
12.6. We are not responsible for fading or discolouration caused by sunlight or chemical exposure.
12.7. We recommend professional dry cleaning for all removable fabric covers.
13. Our Liability
13.1. Our liability does not exclude or limit in cases of (i) death or personal injury caused by our negligence, (ii) fraud, (iii) fraudulent misrepresentation, or (iv) any other liability which cannot be excluded or limited under applicable law.
13.2. Our guarantees apply only to products used non-commercially within the UK.
13.3. We are not liable for any commercial losses or damages incurred through the use of our products.
13.4. Our liability for losses or damages is limited to foreseeable consequences of our breach of these Terms.
13.5. We are not liable for non-performance caused by events outside our reasonable control.
14. Other Services
14.1. Details of additional services such as furniture protection schemes are available upon request. Separate terms apply.
15. Website Purchases
15.1. Specific terms for website purchases are outlined in this section.
15.2. We cannot guarantee accurate color reproduction of products on your monitor.
15.3. Our contract with you is finalized upon receipt of payment and our confirmation email.
15.4. We reserve the right to refuse orders and correct errors on the website.
